Terms of Service
These terms govern your use of Makeload, a load-testing service operated by IT & IoT solutions ApS, Herstedvang 8, 2620 Albertslund, Denmark ("Makeload", "we", "us"). By creating an account or running a test you agree to them. If you use Makeload on behalf of a company, you confirm you may bind that company.
1. The service
Makeload sends controlled test traffic from our generator fleet to a website or API that you choose, and reports the results. The service is intended for business and professional use by people aged 18 or older.
2. Your account
- Give accurate information and keep your credentials and API keys secret. You are responsible for everything done with your account and keys.
- Tell us promptly at hello@makeload.io if you suspect unauthorised access.
- One person or company may not use multiple accounts to get around plan limits or to avoid a suspension.
3. Testing only what you are allowed to test
You may only run tests against websites, services and IP addresses that you own or are explicitly authorised in writing to test. Makeload requires you to prove control of a domain, by a file or a DNS record, before tests can be sent to it. A verified domain belongs to one account at a time.
By starting a test you confirm that you hold that authorisation, including from any hosting provider or third party whose infrastructure the test will touch. The full rules are in our Abuse & Acceptable Use policy, which forms part of these terms.
4. Prohibited use
- Testing any target without authorisation, or attempting to bypass or fake domain verification.
- Using Makeload to carry out or disguise a denial-of-service attack, or to attack third parties in any way.
- Attempting to disrupt, probe or gain unauthorised access to Makeload or its generator fleet, or to read another customer's data.
- Reselling the service or its results without our written agreement.
- Breaking the law or infringing the rights of others.
5. Plans, fees and payment
The free plan is limited as described on the pricing page. Paid plans are billed in advance through our payment processor, Stripe, and renew automatically until you cancel. You can cancel at any time; the plan then runs until the end of the period already paid for. Fees already paid are not refunded, except where the law requires it. Prices exclude VAT, which is added where applicable. If a payment fails we may limit your account to the free plan.
6. Fair use and limits
Each plan has limits on request rate, duration and number of tests. We may apply technical limits to protect the service and other customers, and we may stop a test that endangers the platform or a third party.
7. Suspension and termination
We may suspend or close an account, with or without notice, if we reasonably believe these terms have been broken, a test is causing harm, or we are required to by law or an authority. We will tell you why where we are able to. You may close your account at any time by contacting us. Sections that by their nature should survive termination, including 9 to 12, do so.
8. Your data and results
You keep all rights in your data and in the test results for your account. You give us the limited right to process them to provide the service. How we handle personal data is described in our Privacy Policy.
9. Our rights
Makeload, its software, design and trademarks belong to us and our licensors. These terms give you a right to use the service, not to copy or reverse-engineer it.
10. Availability and warranty
We work to keep the service running and the results accurate, but the service is provided "as is". Load-test results depend on network conditions and on your systems, and are not a guarantee of how your site will behave in production. Unless we have agreed a service level in writing, we do not promise uninterrupted availability.
11. Liability
Nothing in these terms limits liability that cannot be limited under Danish law, including liability for intent or gross negligence. Subject to that, we are not liable for indirect or consequential loss, lost profits, lost data or downtime of your own systems, and our total liability for any claim is limited to the fees you paid to us in the 12 months before the event that gave rise to the claim.
You are responsible for the effects of tests you start. If a test you were not authorised to run leads to claims against us, you will cover our reasonable losses and costs arising from them.
12. Governing law
These terms are governed by Danish law. Disputes are to be settled by the Danish courts, which have exclusive jurisdiction.
13. Changes
We may update these terms. For material changes we will notify you by email or in the app before they take effect. Continuing to use the service afterwards means you accept the updated terms.
